I don't think that any lawsuit on copyright infringement is such a great idea because it is difficult to perceive any damages that have been incurred by such alleged plagiarism. One obvious remedy would be somehow to limit access to the database. Clearly of course, this is not an ideal solution since the archive is meant to be freely accessible to all, and I suppose such plagiarism has to be accepted as a consequence of such an archive. However, it is this type of insecurity that has caused me not to release any of the questions from CWRU tournaments to any free archive. I know I would like to but without any safeguards, it makes no sense to have questions from any tournament we host so open to the public that people can pilfer them at will. What would interest me is if TRASH(tm) questions were being pilfered by various groups in this same manner. My hunch is very doubtful; trash questions in general have a very short shelf life, so an archive of those would be less useful to Chip's "academic" [cough-cough-cough-cough] question stash than not. But yes, I doubt that any of us has actually bothered to register for a copyright on all of our written materials. Hence any lawsuit would not be worth any award we may be given since he presumably assumes copyright on "his" questions. Again, I would have to check a good lawyer on this issue, so don't quote me.
