hi. i'm new here. that out of the way, i think i'd like to weigh in on this subject. first off, i am in no way condoning what mr. beall has allegedly (or probably) done. seems rather sketchy to me. BUT. it is my understanding (correct me if i'm wrong) that under copyright law, the "author," as a defined term, of a work is the person who originally created the work, and it is only he/she or the executor's of his/her estate that can and should make any accusations. the fact that you have "beef," so to speak, with chip's questions really means nothing, unless you are he who wrote that particular question. secondly, under what they call "fair use policy," chip can probably get away with copying a question or two, given the circumstances. 1) he's technically working under the umbrella of "advancing and/or promoting education and/or scholasticism." they kind of like to favor that sort of thing. 2) it was only a small part of the original packet which was copied. this lessens the severity of any offense, and, given the item directly above this, any court would probably dismis this rather abruptly. finally, 3), in this case, what chip may or may not have done doesn't negatively affect the market of the original product. i.e., there is no market for it, per se. it's open to the public, downloadable by anyone. also, the fact that chip makes no money, i presume, directly from his 20 questions kind of softens that issue as well. at any rate, this post is too long as is. i should probably end it. granted, i'm no law scholar. please, correct me if i am wrong. (not about my being a law scholar, knuckleknob reading this. about the above jargon and reasoning.) having played many a QU packet in highschool, i'd say that i'm rather appauled by this whole situation. that's rather crappy of chip if he did do what is alleged. but hey, what can you do? in the end.
